Job Description

1. Background
A local NGO that works to promote good governance, environmental justice and sustainable development in the natural resource sector seeks the services of a consultant to produce draft regulations for relocation in Zimbabwe. It is quite likely that there will be an increased degree of mining-induced displacements in various sections of the nation due to the incremental exploitation of minerals in Zimbabwe and other developments. In such cases, resettlement dynamics need to be properly considered. In the past, mining-induced displacements and relocations have led to a loss of land-based livelihoods, the transfer of people to agriculturally unfeasible land, weaker social networks, and in some cases, the redundancy of skills among moved groups. It is therefore imperative to examine and understand the social dynamics that are embedded in land rights to improve the existing legal framework and policies on mining-induced displacements. The analysis and draft regulations will be used as a critical tool to advocate for the enhancement of the respect of community land rights and inform policy initiatives to mitigate the effects of mining-induced displacements in Zimbabwe.
2. Main Objective
• To engage a consultant who will produce model regulations for relocation processes in Zimbabwe
2.1 Specific Terms of Reference
The consultant, working closely with the organisation’s representative will be expected to:
1. To identify policy and legal gaps that are driving the de-capitalisation of communities leading to poverty and conflicts in mining-affected communities.
2. To come up with model regulations that can be utilised as recommendations on relocations

3. Key Expectations
The Consultant will be expected to;
• Assess the substantive gaps and implementation gaps of the laws and policies by mining companies and the Government when there are situations of mining-induced displacements.
• Produce model regulations that can be utilised as recommendations on relocations that are fair and equitable to enhance community land rights and mitigate the impacts of mining-induced displacements in Zimbabwe.
• Conduct a comparative analysis of relocation regulations from other international and regional best practices and add examples from international standards and cases.
• Guard against plagiarism and reference sources.
4. Key deliverable and Time frame
The consultant should produce a report with model regulations for relocation processes in Zimbabwe, that promote equity on community land rights and that also mitigate the impacts of mining-induced displacements in Zimbabwe. The assignment should be completed within one month of the consultant signing the contract.

Qualifications and Experience

5. Applicant requirements/Relevant qualifications
• At least five years of experience in land rights, extractives, sustainable development, and mineral resource governance work.
• Applications will be considered from applicants with a minimum of a Master’s degree in any one or more of the following areas: law, public policy, development studies or any other relevant field.
• The ability to research, write, review, and produce high-quality work, competency in clear, concise documentation in plain English.
