Job Description

Introduction and Background
A public interest organisation which is into natural resources governance and environmental justice work seeks to hire a consultant to undertake research on the Public Finance Management reforms specifically focusing on the Public Finance Management Act (PFMA) and the Public Finance Management Bill which passed the first reading stage in parliament The amendment to the Public Finance Management Act brings an opportunity to align the public management legislation to the public finance management principles as espoused in Chapter 17 of the 2013 Constitution, the recently passed SADC model law on Public Finance Management and international best practises. Through the analysis of the PFMA and the PFM Bill, the organisation intends to provide proposals to parliament on provisions which can be incorporated into the Amendment Bill to strengthen the management of public revenue including revenue from the mining sector. Key issues of interest to the organisation include reporting and accountability of tax expenditures, access to information on royalties from mining companies, curbing Illicit Financial flows (IFFs) and public procurement.This work is expected to contribute towards improved oversight role of parliamentarians on the management of revenue from the mining sector.
2.0 Main Objective
To undertake an analysis on the conformity of PFMA with the constitution and regional and international public finance management best practises and model laws for example, the SADC Model law on Public Finance Management
3.0 Specific Objectives
• To analyse and review the existing Public Finance Management Act (PFMA) for purposes of identifying gaps that need to be aligned with the Constitution, and other related pieces of legislation
• To identify how the current Public Finance Management Bill responds to the gaps in the Public Finance Management Act and weaknesses and gaps associated with the Bill which passed the first reading stage
• To identify strengths and gaps in the Public Finance Management Bill and compare it with regional and international best practises on Public Finance Management
• To establish how the Amendment Bill can promote citizen participation, accountability of mineral revenue and tax incentives, access to information and disclosure, value for money and fighting against corruption among other issues
• To propose a comprehensive set of provisions that should be suggested by CSOs in response to the Amendment Bill.

Duties and Responsibilities

4. Key Deliverables
• Produce a draft research report
• Conduct validation meetings for the draft research report
• Incorporate feedback from validation meetings and submit the final research report
• Develop a policy brief

Qualifications and Experience

5. Desired qualifications, experience and Skills

• Postgraduate in law or Economics or Development Studies, or related field. A strong understanding of Public Finance Management and Natural Resources Governance issues globally, regionally and nationally. Experience in drafting laws at Government level will be a key advantage.

• At least 5 years of experience in conducting analysis of Natural resources or Public Finance Management Bills and laws or drafting model policy or Bills related to natural resources governance.
Excellent report writing and communication skills.
